Outside of choosing the right house and location, the Offer is the single most important factor to get right for foreigners who are buying a house in Italy. Having an experienced person representing you throughout the Italian Offer process can turn a nightmare scenario into a dream experience.

Without Buyer representation and a formal written Offer such as that provided by HFNI, the Buyer deals directly with the Sales Agent or in rare cases directly with a private Seller. When dealing with only a Sales Agent, without an experienced person representing you –the Buyer, you are at the mercy of that Agent. You are only getting advice from the Sale side representative.
A Sales Agent has a legal and fiduciary duty to represent the best interests of the Seller.
A Sales Agent cannot equally and fairly represent both the Seller and the Buyer – that is a fact.
It’s akin to having the same lawyer represent both the defendant and the plaintiff.
If it is a private sale with no Sales Agent, this is a scenario in which Foreign Buyers should pay particular attention. The only (rare) instances we have had of people trying to sell houses that they did not own in full or in part were private sales.
After you make an Offer (with HFNI or without), the Sales Agent prepares a basic sale document called a Proposta (aka Preliminare or Compromesso). This document is often a template used by the agency which incorporates very few, if any, Buyer protections. It includes basic info, often handwritten, on the Seller and Buyer, the house, the Offer amount, and legalese mostly in favor of the Seller. It addresses payments often citing the same payment procedures used by Italian buyers for thirty years – a bank check as good faith deposit to be “held” by the Sales Agent, unconditional payments made directly to the Seller’s bank account before the deed is signed, payment of agent commission before the Proposta is signed, etc. Most Propostas do not include the provisions necessary for foreign buyers to make safe, secure, and electronic payments.
